Criminal Drug Case Defense Attorney

With the legalization of Marijuana for medicinal purposes in 26 of the 50 States, and the District of Columbia, and its legalization in four States for recreational purposes, there has been an increased vigilance on the part of Kansas Law Enforcement to attempt to stop the trafficking in this drug in Kansas. However, the Kansas legislature has now reduced the penalty for first and second time offenders. First offenders are looking at a potential fine of up to $1,000.00 and a jail sentence of up to six (6) months, second offenders a fine of up to $2,500.00 and up to a one (1) year jail sentence. A third offense, for simple possession of marijuana is a felony. Simple possession of other street drugs (cocaine, crack cocaine, heroin, methamphetamine, etc., carry a potential sentence of a minimum sentence of 10 months in prison to a maximum of 42 months, plus a fine not to exceed $100,000.00. Possession of any drug, with the intent to distribute, or distribution or conspiracy to distribute, all carry a minimum sentence of not less than 14 months to a maximum of 204 months, plus fines of up to $500,000.00, under Kansas law. The sentence that someone will receive is determined by a number of different variables, including, but not limited to: prior criminal history; location (within 1000 feet of a school dramatically increases the potential sentence); and how much of the illegal drug is involved.
